Terms of Service & Legal Agreement

Please read these Terms of Service carefully before purchasing or utilizing any product, server, or software license provided by GlobalHostServ.

1. Agreement & Acceptance

This Terms of Service Agreement ("Agreement") is legally binding between GlobalHostServ.com ("Company", "We", "Us", or "Our") and the client ("User", "You", or "Your"). By placing an order, completing a payment, or accessing any service, server, or software license hosted by GlobalHostServ.com, you explicitly acknowledge that you have read, understood, and agreed to be bound by all terms, policies, and conditions set forth herein.

GlobalHostServ reserves the right to modify, amend, or update this Agreement at any time without prior individual notice. Your continued use of our services following any posted changes constitutes full acceptance of the updated terms.

2. Account Eligibility & Responsibilities

  • Authorized Representation: If you accept this Agreement on behalf of an entity or third party, you warrant that you possess full legal authority to bind that party to these conditions.
  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, API tokens, and server root credentials. GlobalHostServ bears no liability for losses or damages resulting from unauthorized access to your account.
  • Contact Information: You agree to maintain current, accurate, and valid contact details in your client profile. Orders submitted with deliberately falsified information may be flagged as fraudulent and cancelled without a refund.

3. Shared Licensing Systems Terms

GlobalHostServ provides high-efficiency shared licensing systems engineered for control panels and server management tools (including cPanel, WHM, Plesk, and related extensions). By ordering any shared licensing solution, you acknowledge and agree to the following conditions:

  • As-Is Functionality: Shared licenses provide full software functionality on your server but do not include direct official vendor support (e.g., direct support tickets with cPanel Inc.).
  • Official Vendor Contact Prohibition: You explicitly agree NOT to open official support tickets or request assistance directly from official software vendors using shared licensing IPs. Attempting to do so may result in immediate license revocation.
  • Third-Party Vendor Changes: GlobalHostServ is not liable for structural updates, core changes, or API modifications implemented independently by third-party software developers.

4. Acceptable Use & Abuse Policies

GlobalHostServ strives to maintain a privacy-conscious and resilient hosting environment. However, to ensure system stability and infrastructure security, the following terms govern service usage:

  • User Liability: You retain sole legal responsibility for all hosted data, applications, scripts, and network traffic passing through your Virtual Private Server (VPS) or server instance.
  • Prohibited Critical Activities: Under no circumstances may our infrastructure be utilized for activities that pose direct systemic risks, including child exploitation, severe financial fraud, malware distribution, or unauthorized access attempts against critical infrastructure.
  • Manual Notice Evaluation: We evaluate incoming third-party dispute notices manually. GlobalHostServ reserves full discretion to review disputes, request clarifications from the client, or temporarily suspend services if an instance presents an unmitigated threat to physical server hardware or upstream networks.

5. Billing, Payments & No-Refund Policy

  • Pre-payment Obligation: All services and software licenses are provided on a strict advance pre-payment basis. Services will auto-renew according to the billing cycle selected unless a formal cancellation request is submitted via the client portal.
  • Strict No-Refund Policy: Due to the immediate resource allocation, digital delivery of licenses, and server provisioning costs, ALL PAYMENTS MADE TO GLOBALHOSTSERV ARE FINAL AND NON-REFUNDABLE.
  • Chargeback & Payment Dispute Waiver: Initiating an unauthorized chargeback or payment dispute through a bank, credit card issuer, or payment processor constitutes a direct breach of this Agreement. In the event of a chargeback attempt, GlobalHostServ reserves the right to immediately terminate all active accounts, blacklist associated IPs, and submit account records to collection agencies.
  • Late Invoices & Suspension: Invoices remaining unpaid past their due date will result in automated service suspension. Re-activation is contingent upon full settlement of outstanding balances.

6. Limitation of Liability & Indemnification

IN NO EVENT SHALL GLOBALHOSTSERV, ITS DIRECTORS, EMPLOYEES, OR SUPPLIERS BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION ARISING FROM THE USE OR INABILITY TO USE OUR SERVICES.

You agree to defend, indemnify, and hold harmless GlobalHostServ against any legal claims, liabilities, losses, damages, or legal expenses (including reasonable attorney fees) arising from your hosted content, server configurations, or violation of this Agreement.

7. Service Cancellation & Termination

You may request the cancellation of your service at any time through the billing control panel. Cancellation does not entitle you to any pro-rated refund for remaining billing periods. GlobalHostServ reserves the right to terminate access or halt services immediately in cases of non-payment or critical policy violations.
